Caroline and I took a Greyhound from Chilliwack to Marin County
California (there's a trip) and didn't pick up e-mails until Thursday
evening April 8, when I got this one dated April 6 from Scientology
lawyer Andrew H. Wilson:

It was a week late for an April Fools joke, even from Andy Wilson, and
sure enough he e-mailed me on April 7 a corrected notice:

9:00 a.m. on April 9 is, of course, when the trial in Armstrong 7,
Marin SC No. CV 021632 was set to start before Judge Lynn Duryee in
another courtroom, Department L.

Back in July 2001, in Armstrong 4, Marin SC No. 152229/157680,
Scientology had gotten Judge Vernon Smith to sign the cult's order of
contempt finding me guilty of 131 postings to a.r.s. that violated the
1995 injunction signed by former Marin Judge Gary W. Thomas.

(c) Petitioner has shown that:

(1) During the period of February 20, 1998 to July 10, 2000, ARMSTRONG
made a total of 131 postings on the Internet, each of which violated
one or more provisions of the Injunction;

(2) ARMSTRONG traveled to Clearwater, Florida and on December 5, 1999
spoke in direct violation of the Order before a public gathering
sponsored by an organization known as the Lisa McPherson Trust; and

(3) ARMSTRONG traveled to Tampa, Florida and on December 10, 1999 gave
an interview on radio station WNF-AM, during which he again violated
the terms of the Order.

(d) ARMSTRONG did not deny these violations. In his January 9, 2001
declaration under penalty of perjury, ARMSTRONG stated, "I have
violated Scientology's Injunction thousands of times since former
Marin County Superior Court Judge (Gary Thomas) signed it in October,
1995."

IT IS HEREBY ADJUDGED, ORDERED AND DECREED that Defendant GERALD
ARMSTRONG is guilty of Contempt of Court for his intentional and
willful failures to obey the Order as described above. As set forth
above, the Order is valid and enforceable; ARMSTRONG had notice and
knowledge of the Order, had the ability to comply with the Order and
repeatedly and admittedly willfully disobeyed the Order. The Court
notes that there are two outstanding Bench Warrants which resulted
from two previous contempt convictions which also arose out of
ARMSTRONG's violations of the Order. The Court will not impose a
specific punishment at this time. However, this Court retains
jurisdiction and at such time as ARMSTRONG is apprehended, he is to be
brought before this Court for the consideration of additional
sanctions for the aforesaid acts of contempt after hearing from both
sides.

Knowing that I was intending to show up for trial in Armstrong 7
before Judge Duryee, Wilson and his cult handlers had to have figured
they'd get Judge Smith to give me a bunch of jail time and a
gargantuan fine and would have me arrested. Hopefully they'd have me
jailed and not able to defend myself at trial, and at a minimum they
could whipsaw me between the two courtrooms, and influence or even
pressure Judge Duryee to punish me if they got Smith to impose some
stiff punishment.

In the afternoon of April 8, before I got Wilson's e-mail notice that
he would be appearing ex parte before Judge Smith to get him to
"impose sentence for the acts of contempt," Ford Greene filed a
substitution of attorney in Armstrong 7, and served Wilson by fax.

When we arrived at the courthouse for the trial and for the ex parte
appearance, Wilson announced that the cult would *not* be proceeding
with the effort to get Judge Smith to impose sentence for the 131
contempts.

I believe that the cult backed off from this sleazy two-courtroom
scheme just because Ford subbed into the case. It is one thing to jerk
around a pro per, forma pauperis, Greyhound-riding defendant, and to
get a willing judge to use the law to harass him, and a whole
different thing to pull that skulduggery with a real live
fire-breathing lawyer who has the cult's number, and in his home
court.
