Declaration of Gerry Armstrong

I, Gerry Armstrong declare:

1. I am the target of a series of threatening, harassive and libelous e-mails and Usenet posts made by Cox Net customer "billhughes@cox.net" in violation of Cox's Acceptable Use Policy.

2. On April 6, "Mr. Hughes" sent me an e-mail message at gerry@gerryarmstrong.org with subject line "Hey goatfucker," which he also posted to the newsgroup alt.binaries.pictures.drag-racing, falsely accusing me of being the source of an apparent earlier post to that newsgroup, and giving my street address and phone number. (A. and Aa. below) He also addressed the message to gerryarmstrong@shaw.ca and garmstrong@shaw.ca. It is clear to me that "Mr. Hughes" is claiming a prior knowledge of me and hate for me as "Gerry Armstrong."

3. I responded by e-mail to "Mr. Hughes," advising him that I was the Gerry Armstrong he was targeting and that he was falsely accusing me. (B. below) I have never to my knowledge had any interaction with "Mr. Hughes" before he e-mailed me on April 6, nor was I aware of his existence before then.

4. "Mr. Hughes" sent me a second e-mail message, still essentially falsely accusing me, further accusing me of trying to fool people into thinking I don't live at my current address in Chilliwack, BC., Canada, implying something nefarious about my mail server being in Germany, and asserting that NNTP No. 24.67.253.205 is me. (C. below) In fact, that NNTP is a static number for numerous shaw.ca news subscribers.

5. I responded by e-mail to "Mr. Hughes," explaining that I was not trying to fool anyone, and that he was making a fool of himself for falsely accusing me and not explaining why. I asked him if he was a Scientologist, or whether it was his job to falsely accuse people or commit other crimes for the cult, or why he was targeting me. (D. below)

6. I am a target of the Scientology organization, which uses private investigators and intelligence professionals, including computer experts against its targets. Obviously I have a very known Internet identity, and use the Internet in my work, writing and communicating. It is not inconceivable that "Mr. Hughes" is part of a Scientology operation, wittingly or unwittingly. Scientology uses gullible, vulnerable, deranged and sociopathic individuals in its war campaigns against people it targets as "enemies," like me. I have sometimes found it safest and wisest to express my suspicion that someone approaching me, especially, as with "Mr. Hughes," someone attacking me out of the blue, might be connected to or operated by, the Scientology organization. His garbage about me in his first e-mail message, that I am a "habitual lying coward" and "a total loser," are very usual black propaganda disseminated by Scientology's leaders and covert agents about me. Scientology agents have physically assaulted me on multiple occasions, a Scientology private investigator in southern California threatened to put a bullet between my eyes, in 2005 a Scientologist posting anonymously incited deranged people to get a gun and shoot me, and less than a month ago another Scientologist posting from a Shaw account threatened to shoot my wife.

7. "Mr. Hughes" sent me a third e-mail message, vulgarly, again implying that by having a German mail server I was trying to fool people, and conceiting himself for not being snowed by me. (E. below) He also commanded me to use some e-mail account with Shaw Internet and not use the one I have used openly and publicly for over three years, gerry@gerryarmstrong.org.

8. "Mr. Hughes" also posted his third e-mail to the newsgroup alt.intenet.services. (Ea. below)

9. I responded by e-mail, again asking him why he was falsely accusing me, if he was a Scientologist or if it was his job, and why he was targeting me. (F. below)

10. "Mr. Hughes" sent me a fourth e-mail message, stating: "Gerry, you admit you live in Chilliwack, yet you will not use your Shaw address as I asked. You're going straight to Hell!" (G. below)

11. I responded by e-mail, denying the admission "Mr. Hughes" was claiming I'd made, and pointing out that my postal address in Chilliwack is "on my contact page on my site and in a hundred documents filed in U.S. courts and webbed on my site," and I provided URLs to support this statement: http://www.gerryarmstrong.org/50grand/legal/index.html

12. "Mr. Hughes" sent me a fifth e-mail message, accusing me of being a lair (sic) and claiming that a Google search he did proves I "use the number associated with the attacks on [him]." He provided this URL for his "search:"

13. I responded by e-mail, protesting that he was falsely accusing me, and expressing my belief that he was deliberately accusing me falsely. (J. below) I asked him what attacks on him he was accusing me of, since he had not been clear at all about what he was claiming I had done that brought him to accuse me of doing it.

14. I also sent "Mr. Hughes" a URL for a Google groups search result using search term "24.67.253.205." http://groups.google.com/groups?as_q=&num=100&scoring=d&hl=en&as_epq= 24.67.253.205&as_oq=&as_eq=&as_ugroup=&as_usubject=&as_uauthors=&lr=&as_drrb=q&as_ qdr=&as_ mind=1&as_minm=1&as_miny=1981&as_maxd=6&as_maxm=4&as_maxy=2006& safe=off This search result demonstrates that all kinds of people who are Shaw Internet customers have NNTP 24.67.253.205.

15. The Google search that "Mr. Hughes" apparently performed to have proved that I was NNTP 24.67.253.205 had search terms "Gerry Armstrong" plus "24.67.253.205." In so doing, naturally, "Mr. Hughes" could "eliminate" any possibility that any of Shaw's thousands of other Internet customers might show up in his "search."

16. "Mr. Hughes" sent me a sixth e-mail message, stating: "I'm through playing your game." (K. below)

17. I responded by e-mail: "You e-mailed me out of the blue, falsely accusing me of attacking you. You lied about me. You threatened me. I do your research for you and prove to you you're wrong. And instead of correcting your false accusations you further falsely accuse me of playing a game, and like a willful spoiled brat you say you're through playing it. I urge you to correct your false accusations and retract your threat immediately." (L. below) This was my last e-mail message to "Mr. Hughes."

18. "Mr. Hughes" sent me a seventh e-mail message, stating: "YOU NEED HELP!" (M. below) He also included a URL for a Google web search result using the single term "24.67.253.205." http://www.google.com/search?q=%2224.67.253.205%22&hl=en&lr=&ie=UTF-8&start=0&sa=N And he included a URL for a Deutsche Google groups search result also using the single term "24.67.253.205."

I believe that either and both of these searches that "Mr. Hughes" apparently did demonstrate that many people in the world besides me use Shaw News Service and share a single NNTP number, specifically 24.67.253.205.

19. On April 8, "Mr. Hughes" sent me an eighth e-mail message which purports to be a complaint addressed to abuse@mixmaster.it and abuse@shaw.ca. "Mr. Hughes" implies he is complaining about me, and includes a vulgar phrase, "My cock, in your mouth, suck it." (N. below)

20. On April 10, "Mr. Hughes" sent me an ninth e-mail message which purports to be a complaint addressed to abuse@mixmaster.mixmin.net, security@csail.mit.edu, and abuse@shaw.ca. "Mr. Hughes" implies he is complaining about me. (O. below)

21. On April 10, "Mr. Hughes" sent me an tenth e-mail message which purports to be a complaint addressed to anonymous.posterabuse@remailer.hastio.org, abuse@nym.alias.net, security@csail.mit.edu and abuse@shaw.ca. "Mr. Hughes" implies he is complaining about me. (P. below) "Mr. Hughes" also sent copies of his two e-mail messages of this date to my wife Caroline Letkeman.

22. "Mr. Hughes" is clearly falsely accusing me and appears to be doing so willfully. He either has, or is pretending to have, a level of computer and Internet knowledge far beyond mine. What I know, with my more modest computer and Internet understanding, is that he is lying, and I did not do whatever he is falsely accusing me of doing. He is acting menacingly and is either mental or is appearing mental deliberately to make himself menacing. He appears, from a quick review of a few of his Usenet posts, to be a gun "enthusiast" or nut, who boasts of keeping loaded guns racked in his home.

23. I request that you do whatever is within your power to talk some sense into "Mr. Hughes" and to prevent him from further defaming, harassing or threatening me, my wife, and others.

I declare under penalty of perjury under the laws of California, the United States and Canada that the foregoing is true and correct.
